REPRESENTATIVE LEGAL MATTERS |
In a case involving a 12-year marriage where the wife was a full-time homemaker and the primary assets were formed with financial support from the opposing party’s parents, we successfully demonstrated the client’s contributions to the management, maintenance, and appreciation of the assets. As a result, the court recognized a 50% contribution to the marital property. |
We were retained after the opposing party had already been granted temporary parental authority and custody, along with a child return order. By filing an appeal against the provisional disposition and a counterclaim for property division, we successfully secured both parental authority and custody for our client, along with a favorable ruling on property division. |
We argued comprehensively based on the client’s firm intent to maintain the marriage, the child’s wishes, the circumstances of separation, and the opposing party’s fault. The court ultimately dismissed the divorce claim. |
In a case where the spouse unilaterally reduced and suspended living expenses, we established a breach of the duty of support by demonstrating the standard of living during the marriage, the opposing party’s income, and prior payment history. The court awarded future spousal support of KRW 10 million per month and recognized past support in the amount of KRW 25 million. |
After being retained following the failure of initial mediation, we clarified key issues through pre-negotiation and proceeded with re-mediation. Within two months, the case was successfully resolved with an agreement granting KRW 3 billion in property division and KRW 5 million in monthly child support. |
In a case where the defendant denied awareness of the marital relationship, we systematically analyzed the course of the relationship, communications between the parties, and surrounding circumstantial evidence to prove such awareness. We also effectively exposed inconsistencies in the defendant’s arguments. The court ultimately ordered the defendant to pay KRW 40 million in damages. |
Although the extramarital relationship was acknowledged, we argued for limitation of liability and reduction of damages based on the duration and circumstances of the relationship, and, together with legal defenses, secured a judgment dismissing the plaintiff’s claims in their entirety. |
